Registering a marriage with the Indian consulate
A marriage solemnised in the United States can be registered with the Indian consulate, which produces an Indian record of it. That record is what banks, visa authorities and property registrars in India ask for.
When you need it
For a spouse visa or a spouse OCI, for property transactions in India, for pension and insurance claims, and for anything where an Indian institution needs the marriage on its own paperwork rather than on a US county certificate.
The US marriage certificate normally has to be apostilled by the issuing state before the consulate will register it.What is asked for
| Document | Note |
|---|---|
| US marriage certificate | Apostilled by the issuing state |
| Both passports | Original and copies |
| Proof of address | Establishes the consular district |
| Photographs | To specification |
Both parties
Most consulates require both spouses to appear, or a notarised declaration from the one who cannot. Check before booking a single slot.

- Apostille the US certificate first
- Both spouses, or a declaration from the absent one
- Originals, not copies
- Ask whether the Indian institution wants this or the US certificate
- Two separate money orders, fee and fund
Registration under which act
A marriage solemnised abroad between Indian citizens can be registered under the Foreign Marriage Act. Where one spouse is not Indian, or where the marriage was performed under US law only, the consulate registers the fact of it rather than the marriage itself.
The distinction matters to a sub-registrar in India and to nobody else, but it changes which certificate you end up holding.
Spouse visas and spouse OCI
A foreign spouse of an Indian citizen or of an OCI holder can apply for an OCI, and the marriage has to have subsisted for a period the rules set out. The registered marriage certificate is the document that application is built on.
Doing the registration early, rather than when the visa is needed, removes the step that always turns out to be the slow one.
Names on the certificate
US marriage certificates often record names as they appear on a driving licence rather than on a passport. Where the two differ, the Indian registration will follow the passport, and the mismatch has to be explained rather than ignored.
If a spouse changed their name on marriage, decide before registering whether the Indian record should carry the old name, the new one or both. It is far easier to set than to amend.
